Fake ICC Documents
Many of you will have come across fake “ICC” documents, which exist in a diverse variety of forms and types, and have been approached by members of the public which have received or relied upon such documents.
To help people who receive such documents identify such fakes, we have put an FAQ on the website called
“ Identifying a genuine ICC document” available at http://www.iccwbo.org/FAQs/Identifying-a-genuine-ICC-document/
This describes the kind of documents that ICC does not issue, warns the public not to rely on such documents and disclaims ICC’s responsibility for these. It also gives the public addresses to contact in NCs and at IHQ if they would like feedback on particular documents.
ICC Model Agreements
Whether one is an ICC member or not has no impact whatsoever on an ICC model agreement (except that you may get a discount when buying it). Anyone who buys them can use them, whether or not they are a member. There is no question of “validity” of the document except to the extent that ICC updates them from time to time so that older versions may become outdated. They are ICC tools which are not restricted to members but are subject to copyright rules. Purchasers can use them as many times as they want to prepare agreements but cannot put the electronic copies provided with the publication on the Intranets of their companies without getting a licence from Publishing. Below is the new copyright notice we will be using for model contracts which sets this out.
